Local officials in Gov. Phil Murphy’s hometown received a stern rebuke from an obscure but powerful board that hears constitutional challenges to state laws after they sought to have New Jersey’s bail reforms declared an “unfunded mandate.”
Middletown had asked the Council on Local Mandates to toss the 2017 changes to the state’s bail system, which replaced cash bail with a set-up where judges guided by an assessment algorithm determine whether to lock up someone pending trial.
It declined in a June 27 ruling, calling the township’s complaint “fundamentally a press release rather than a pleading.” The ruling marked the second time the council upheld the constitutionality of the criminal justice reform act that set up the new system.
