A San Francisco judge has sentenced the man who attacked former House Speaker Nancy Pelosi’s husband with a hammer to life in prison without possibility of parole.
Superior Court Judge Harry Dorfman sentenced David Wayne DePape on Tuesday after his conviction in June on charges of aggravated kidnapping, first-degree burglary and false imprisonment of an elder, Paul Pelosi, who was 82 at the time.
The attack left Paul Pelosi bleeding and unconscious after DePape broke into his home in October 2022 looking for his wife with zip ties and a hammer. She wasn’t home. But DePape echoed the Capitol rioters on Jan. 6, 2021, by yelling: “Where’s Nancy?”
The Pelosi family issued a joint statement saying “legal justice had been served.”
“Mostly, we are in awe of Pop’s courage on that horrible night two years ago – as well as on the witness stand at two criminal trials and every day of his recovery from the vicious assault on his life,” the statement said. “Since the violent break-in and shouts of ‘where’s Nancy?’ two years ago, not a day goes by that we do not think of this devastating assault, its trauma – or the possibility of future attacks.”
The sentencing was the second for the attack. U.S. District Judge Jacqueline Corley sentenced DePape to 30 years in prison after his federal conviction in November 2023 on charges he attempted to kidnap a federal official and assaulted an immediate family member of a federal official.
DePape’s lawyers had argued for shorter sentences by saying his adult life was distorted by an abusive long-term relationship, according to court records. The lawyers also said he was “radicalized through his obsessive consumption of media amplifying extreme beliefs,” the court records said.
DePape said he knew he would be caught on Ring security cameras positioned around the exterior of the Pacific Heights house, according to court records. But he was surprised to find Paul Pelosi still asleep after the noise he made smashing the window of a glass door to get inside.
Pelosi, who was sleeping in a pajama top and boxer shorts, awoke to find DePape standing over him with a hammer in his right hand and several white zip ties in his left hand, according to court records. Pelosi asked why DePape wanted to see his wife.
“Well, she’s No. 2 in line for the presidency, right?” DePape allegedly said. “We’ve got to take them all out.”
Pelosi was able to call police, but when they arrived, DePape smashed Pelosi on the head with the hammer, according to court records. The blow knocked Pelosi unconscious. The two officers rushed into the house and tackled DePape and disarmed him.
In a letter to the judge, Pelosi described continuing pain in his head and arm from the attack. He has lumps on his head, a metal plate in his skull, persistent dizziness and lingering pain in his left hand, he said.
“When I awoke in a pool of my own blood, I had severe head, arm and hand injuries,” Pelosi told Dorfman in requesting the most severe punishment possible for DePape. “I need to sleep during the day and cannot tolerate bright lights or loud noises for extended periods of time.”
