Two Ohio lawmakers have introduced a bill that would change how Issue 1, regarding reproductive rights, including abortion, is implemented.The bill, sponsored by Ohio representatives Bill Dean (R-Xenia) and Jennifer Gross (R-West Chester), was introduced in the House on Jan. 3.The bill would make it so the Ohio General Assembly, not the courts, would have exclusive authority over implementing Issue 1, which covers reproductive decisions, including but not limited to decisions on contraception, fertility treatment, continuing one’s own pregnancy, miscarriage care and abortion.The bill states that, if passed, any pending or new lawsuits, claims, counterclaims, third-party claims to implement Issue 1 would be dismissed and past decisions would be vacated. If passed, any violation of the bill would constitute in a misdemeanor.According to the bill, it would take effect immediately if signed into law.The bill comes just two months after Ohio voters approved a constitutional amendment on that ensures access to abortion and other forms of reproductive health care.Existing abortion-related lawsuits are moving again through the courts now that voters have decided the issue, raising questions about implementation.The amendment declared an individual’s right to “make and carry out one’s own reproductive decisions” and passed with 57 percent majority. It was the seventh straight victory in statewide votes for supporters of abortion access nationally since the U.S. Supreme Court overturned constitutional protections.
